    Unhappy No ILR/ been told to leave house

    Hi, my wifes freind has been here 5 odd years, hasnt got her ILR yet, she extended by 2 years some time ago, situation is that her husband has been abusing her for some time, mentally that is and tonight told her to f--k off and leave his house.
    She has 3 children, 2 with him, one with her ex thai Husband who is here as well,
    She has no money as such and same as me, dosent have a clue what to do or what will happen, anyone advise a course of action, i am going to ring the council for her tommorow, but suspect they will not want to know as she has no ILR, and wont be eligable for housing etc???

    short of me going round there and kicking a few grand out of him for a deposit i just dont know what to do for her?

    I'm sure one of the legal eagles here will advise you but I really don't think this woman has to worry about being sent home.

    Is her FLR still current or have the extensions run out now?

    Also...........thinking here, when did the new regulations for ILR start guys? Did she actually need extensions? Surely someone entering 5 years ago was under the old rules and would have been given ILR after 2 years as a matter of course providing she was still with her husband?

    Whether she is or is not eligible for accommodation, the 2 kids born to a UK father certainly are. I think she should see a solicitor ASAP - that cannot be a healthy environment for kids to live in. Has the husband said that he wants the kids to stay with him?

    She missed the automatic visa by a few months, she has been studying to take the test for ages, but with 3 kids finds little time, surprisingly her husband doesnt help or incourage her.
    Noi he doesnt want the kids, even the youngest who is one in a fortnight.

    please pm me with this ladies location. I may ( not definitely ) be able to assist.

    Meanwhile please advise away guys. And by the way I agree with Flip she should not worry about getting sent back to Thailand ( if she listens and acts upon advise given )

    No, that is not an issue. If she is being subjected to domestic violence, and that includes mental abuse, she should be assisted by the Council.

    Hi, thanks for the replys.

    she is currently staying with myself and familly, and i have got her an apointmnet with the council who have said that she will be eligble for help, i have also got her an apointment with immigration as well.
    Biggest prob we will have i think is benefits, as she wont qualify becasue of the visa, so i am currently looking into that.
    croydon was not vert helpful, very non comital but did say if she can prove domestic abuse she can apply on them grounds, did put me in touch with immigration helpline who provide legasl advise free.
    Sorry abot the bad grammer and spelling, in a rush,been soooo busy this last 2 days.

    It has been mentioned before on this forum, that it helps if she has reported incidents to the police, or been treated by a doctor. If she did not involve either, it becomes more difficult to prove.

    Mental abuse will be more difficult to prove Dave. Unless she can show she understood Arthur's posts that is.

    Many thanks all, application now gone in for visa, no proof of abuse as such only neighbours statements etc, but no other options.

    will let you all know how whe got on.
